On 24 January 2024, the European Commission published a proposal for a new regulation, repealing and replacing the current EU FDI Screening Regulation. In addition, the EU Foreign Subsidies Regulation recently incorporated a new notification scheme for transactions above a certain threshold.

The Biden Administration also released an executive order on the establishment of an outbound investment screening mechanism with implications for investments in China and other countries of concern. Since then, the EU has already announced its plans to consider introducing a similar instrument.
