There is a high expectation on both Spanish companies and subsidiaries of foreign companies that operate in Spain to review their compliance programmes and to align them to the new legal requirements under the 2015 Criminal Code Reform.

The amendment to the Criminal Code has caused a revolution in all companies as the reform created a very defined space for the compliance programmes. Earlier this year, the Public General Prosecutor Office and the Supreme Court have recently ruled on the criminal liability of the legal entities, adding new interpretive criteria which companies must take into account when reviewing and updating their compliance programmes.
