Preventing Sanctions Breaches in an Era of Increased International Enforcement and Co-Operation

Over the last several months, there have been a number of considerable regulatory and enforcement developments, concerning economic sanctions. These developments include new US legislation concerning Iran sanctions, a new UN Security Council resolution, and agreement to considerably strengthen EU-Iran sanctions. The legislation will expand the scope of the Iran Sanctions Act (“ISA”) to impose sanctions on non-US companies that provide refined petroleum products oil or liquefied natural gas, natural gas resources, oil or liquefied natural gas tankers, and products used to construct or maintain pipelines used to transport oil or liquefied natural gas and related services to Iran. 

There have been substantial fines and penalties levied for sanctions breaches. The largest fine ever imposed for violations of US sanctions regulations of £231 million to Lloyds TSB penalty, the latest ANZ Bank’s settlement of $5.75 million, the $536 Million settled by Credit Suisse AG as well as other investigations into the shipping industry, remind the business community of the high cost for not complying with economic sanctions laws.

Under this climate of increased regulatory restrictions and risk, global companies and manufacturers within the petroleum, energy industries and financial institutions operating worldwide must urgently set up preventative measures and enhance existing compliance programmes. Failure to detect and prevent sanctions breaches is otherwise likely to result in staggering penalties and reputational damage.
