The UK Bribery Bill which will come into force in 2010 has proved this point. The Bill will make it illegal to bribe a foreign official to obtain or retain business. If businesses fail to prevent a bribe being paid by their employees or by other firms on their behalf, they will face prosecution. The new corporate offence means that unlimited fines may be imposed on companies found guilty and individuals who make illegal and improper payments to secure business may face fines and imprisonment of up to ten years. Organisations which have not reviewed their risk profile are increasingly exposed. Recent cases of fraud underscore the importance of due diligence robust systems of control to detect and prevent fraudulent activities and that companies need to implement.
